User Agreement — Aria AI: Character Chat

Please read this User Agreement ("Agreement") carefully. By accessing or using Aria AI: Character Chat ("the App"), you agree to be bound by these terms. If you do not agree, do not use the App.

This Agreement is governed by the laws of Spain and applicable European Union regulations, including Directive 2011/83/EU on Consumer Rights and Regulation (EU) 2022/2065 (Digital Services Act).

1. Eligibility

You must be at least 18 years old to use the App. By creating an account, you represent and warrant that you meet this age requirement. We reserve the right to suspend or terminate accounts that violate this restriction without prior notice.

If you are accessing the App on behalf of a legal entity, you additionally represent that you have authority to bind that entity to this Agreement.

2. Service Overview

Aria AI provides AI-powered chat experiences with customizable virtual characters. All characters, dialogues, and scenarios are entirely fictional and for entertainment purposes only. The App does not provide real relationships, companionship, therapy, or professional advice of any kind. AI responses are generated automatically and may be unpredictable.

3. Account Registration & Security

You must provide accurate and complete information when registering.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
You must notify us immediately at aria.app.characters.info@gmail.com if you suspect unauthorized access to your account.
We reserve the right to refuse registration or cancel accounts at our discretion.

4. User Conduct

You agree not to:

Upload, share, or transmit content that is illegal, harmful, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable.
Impersonate any person or entity or misrepresent your affiliation with any person or entity.
Harass, threaten, or defame other users or interact with the AI in ways intended to generate harmful content.
Attempt to reverse-engineer, decompile, disassemble, exploit, or tamper with the App, its AI models, or its infrastructure.
Use automated tools, bots, or scripts to access or interact with the App without our prior written consent.
Use the App for any unlawful, unauthorized, or commercially exploitative purpose.
Attempt to circumvent security, access controls, or content moderation systems.
Generate, solicit, or distribute content involving minors in any sexual or exploitative context. This is strictly prohibited and will result in immediate termination and reporting to the relevant authorities.

Violation of these rules may result in immediate account suspension or permanent termination, at our sole discretion, without refund.

5. Virtual Currency & In-App Purchases

5.1 Gems (Virtual Currency)

The App uses a virtual currency system ("Gems") to access certain features and interactions. Gems have no monetary value, are non-transferable, and cannot be exchanged for real money or redeemed outside the App.

5.2 Purchases

All purchases are processed through Google Play and are subject to Google's payment terms.
Prices are displayed in your local currency at the time of purchase and include any applicable taxes.

5.3 Refund Policy

General rule: All purchases of virtual goods and Gems are final and non-refundable once consumed or credited to your account.
EU/EEA Consumer Rights Exception: If you are a consumer located in the European Union or European Economic Area, you may have a statutory right of withdrawal of 14 days from the date of purchase for digital content that has not yet been accessed or consumed, in accordance with Directive 2011/83/EU. By initiating use of purchased digital content before the 14-day period expires, you expressly acknowledge that you waive this right of withdrawal.
Refund requests required by applicable law will be honored. Contact aria.app.characters.info@gmail.com for assistance.

5.4 Subscriptions

If the App offers subscription plans, the billing cycle, renewal terms, and cancellation procedure will be clearly displayed before purchase. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current billing period via your Google Play account settings.

6. Content Ownership & License

6.1 App Content

We retain all intellectual property rights to the App's software, AI models, character designs, and AI-generated content. Nothing in this Agreement transfers any such rights to you.

6.2 User-Generated Content

You retain ownership of content you create or upload ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free, sublicensable license to use, reproduce, display, and distribute that content solely to provide and improve the App and its services. This license ends when you delete the content or your account, subject to reasonable technical delays.

6.3 Prohibited Content

You must not upload content that infringes third-party intellectual property rights, contains malware, or violates any applicable law.

7. AI-Generated Content & Disclaimer

All content generated by the App's AI is fictional and automated. We do not review AI responses in real time. You acknowledge that:

AI responses may be inaccurate, inappropriate, or unexpected.
The App is not a substitute for professional medical, psychological, legal, or other advice.
We are not responsible for decisions made based on AI-generated content.

If you encounter content you believe is harmful or inappropriate, use the in-app Report function or email aria.app.characters.info@gmail.com. We aim to review reports within 48 hours.

8. Intellectual Property — Third-Party Characters

Some characters available in the App may be inspired by publicly known fictional works. We do not claim ownership of third-party intellectual property. If you are a rights holder and believe your IP is being used without authorization, please contact us at aria.app.characters.info@gmail.com and we will respond promptly.

9. Termination

We may suspend or terminate your account at our discretion for violation of this Agreement, with or without prior notice. Upon termination:

Your right to access the App and use any accumulated Gems ceases immediately.
We may delete your data in accordance with our Privacy Policy.
Termination does not entitle you to a refund except as required by applicable law.

You may delete your account at any time via the App settings or by contacting us.

10. Disclaimers

"As-Is" Service: The App is provided without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or uninterrupted availability.
Service Interruptions: We do not guarantee that the App will be available at all times. Scheduled maintenance or technical issues may cause temporary interruptions.
No Liability for AI Content: We are not liable for emotional distress, reliance on AI outputs, or other harms resulting from AI-generated content.
Consumer Rights: Nothing in this section limits any rights you may have under mandatory applicable consumer protection law in your country of residence.

11. Limitation of Liability

To the maximum extent permitted by applicable law, our total liability for any claim arising from your use of the App is limited to the amounts paid by you (if any) in the 12 months preceding the event giving rise to the claim.

We are not liable for indirect, incidental, special, consequential, or punitive damages, including loss of data, profits, or goodwill.

Note for EU/EEA consumers: The above limitations do not exclude or restrict liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under mandatory applicable law.

12. Governing Law & Dispute Resolution

This Agreement is governed by the laws of Spain, without regard to conflict of law principles, and in compliance with applicable European Union regulations.

For EU/EEA consumers: You may also benefit from any mandatory protective provisions of the law of your country of residence. The limitation of governing law to Spain does not deprive you of the protection afforded by such mandatory provisions.

Dispute Resolution:

We encourage you to contact us first at aria.app.characters.info@gmail.com to resolve any dispute amicably.
If a dispute cannot be resolved informally, it shall be submitted to the competent courts of Spain.
EU consumers may also use the European Commission's Online Dispute Resolution (ODR) platform: https://ec.europa.eu/consumers/odr.

13. Changes to This Agreement

We may update this Agreement from time to time. Material changes will be communicated via the App or by email at least 15 days before they take effect, with a revised "Effective Date" at the top of this document. Continued use of the App after such notice constitutes acceptance of the revised terms. If you do not agree with changes, you may delete your account before they take effect.

14. Severability

If any provision of this Agreement is found to be unenforceable or invalid under applicable law, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force.
